DMCA Copyright Policy

UnusualPlaces.org respects the intellectual property rights of others and expects users, contributors, and third parties to do the same.

This policy explains how to submit a copyright infringement notice under the Digital Millennium Copyright Act, 17 U.S.C. ยง 512, and how to submit a counter-notification if you believe material was removed or disabled by mistake.

Reporting Copyright Infringement

If you believe that material available on UnusualPlaces.org infringes your copyright, you may send a written DMCA notice to our designated copyright contact.

To be effective, your notice should include substantially the following information:

  1. Your physical or electronic signature, or the signature of a person authorized to act on behalf of the copyright owner.
  2. Identification of the copyrighted work you claim has been infringed. If your notice covers multiple copyrighted works, you may provide a representative list.
  3. Identification of the material you claim is infringing, including the specific URL or location on UnusualPlaces.org where the material appears, with enough detail for us to locate it.
  4. Your contact information, including your name, mailing address, telephone number, and email address.
  5. A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, the copyright ownerโ€™s agent, or the law.
  6. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the copyright owner.

What Happens After We Receive a Valid DMCA Notice

When we receive a complete and valid DMCA notice, we may:

  • remove or disable access to the allegedly infringing material;
  • notify the person or party responsible for the material, when appropriate;
  • provide a copy of the notice to that person or party;
  • document the notice for our records; and
  • take action under our repeat infringer policy where applicable.

We may reject, ignore, or request clarification for notices that are incomplete, unclear, abusive, fraudulent, or do not substantially comply with the DMCA.

Counter-Notification Procedure

If material you posted or provided was removed or disabled because of a DMCA notice, and you believe the removal was the result of mistake or misidentification, you may send a counter-notification to our copyright contact.

To be effective, your counter-notification should include substantially the following information:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed or disabled, and the location where it appeared before removal or disabling.
  3. A statement, made under penalty of perjury, that you have a good-faith belief that the material was removed or disabled because of mistake or misidentification.
  4. Your name, mailing address, telephone number, and email address.
  5. A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, or, if your address is outside the United States, that you consent to the jurisdiction of any judicial district in which UnusualPlaces.org may be found.
  6. A statement that you will accept service of process from the person who submitted the original DMCA notice or that personโ€™s agent.

Restoration of Removed Material

If we receive a valid counter-notification, we may forward it to the party who submitted the original DMCA notice.

Unless that party informs us that they have filed a court action seeking to restrain the allegedly infringing activity, we may restore the removed material in accordance with the DMCA.

Repeat Infringer Policy

UnusualPlaces.org may, in appropriate circumstances, remove content and/or terminate access for users, contributors, or account holders who repeatedly infringe copyrights or repeatedly submit infringing material.

We reserve the right to determine, in our reasonable discretion, what qualifies as repeat infringement.

Misrepresentations

Please be aware that knowingly submitting false or misleading DMCA notices or counter-notifications may result in legal liability.

You should not submit a DMCA notice unless you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.

Fair Use and Other Legal Uses

Before submitting a DMCA notice, please consider whether the use of the material may be allowed by law, including fair use, public domain status, license, permission, commentary, criticism, news reporting, education, or other lawful exceptions.
